This policy applies to anyone uploading audio files to MusiciansCollaboration.com ("MusiciansCollaboration.com").
Audio Upload Copyright Policy
MusiciansCollaboration.com does not permit copyrighted audio samples uploaded without prior written permission from the copyright holder. If you are uploading a remix of another artist's recording, you must obtain prior written permission from both the owner of the original recording and the owner of the underlying musical composition. Tracks determined by MusiciansCollaboration.com to be "pirated" recordings will be deleted immediately in the event that management is advised of the infraction.
You may upload cover songs on MusiciansCollaboration.com, but only after you obtain all necessary licenses from the publishers of that song. You should be able to identify the publisher(s) of most songs by examining liner notes of recordings containing the song or by searching one or more publicly accessible online databases, such as the U.S. Copyright Office's Copyright Catalog of Music, ASCAP's ACE Database and BMI's Repertoire Search. However, you are not required to obtain an Internet performance license from the performing rights organizations in the United States, such as ASCAP, BMI or SESAC.
While MusiciansCollaboration.com reserves the right to require proof that you secured a valid license pertaining to any cover song uploaded to the web site, DO NOT submit license copies unless expressly requested to do so. MusiciansCollaboration.com does not accept unsolicited licenses, copies of correspondence or email confirmations from publishers concerning cover song licenses and will refuse, return or discard all such documents. If proof of licensing is requested by MusiciansCollaboration.com, then you must provide us with such proof by fax, email, or letter within three (3) days of the request.
MusiciansCollaboration.com reserves the right to remove any content that it deems inappropriate or illegal.
Please note, not only are you responsible for obtaining all necessary permissions, licenses and consents prior to posting any content to MusiciansCollaboration.com, you may be held liable for any and all costs and expenses (including legal fees) incurred by MusiciansCollaboration.com as a result of your unauthorized use of copyrighted materials.
Cover Song Posting Requirements
When posting a cover song to "Finished Works", or any other forum at MusiciansCollaboration.com, you must abide by this policy, and include the following statement in the text portion of the post:
"I, the poster of this message, which includes an attached audio file containing a cover song or remix, have obtained the necessary permission and/or licensing to do so. I understand that if requested, I must provide proof of said permission to MusiciansCollaboration.com staff within three (3) days. "
Report copyright violations to abuse@MusiciansCollaboration.com
Copyright Infringement Notification
If you believe that an audio file hosted by MusiciansCollaboration.com violates copyright law, then contact abuse@MusiciansCollaboration.com and we will launch an investigation. Any such investigation will be concluded within five (5) days of receiving such notification. If it is determined that the audio file is in violation of the law, the MusiciansCollaboration.com will immediately remove the content and cooperate fully in any legal efforts against the infringing party. If it is determined that the audio file does not violate copyright law, then papers demonstrating such will be provided.
Policy Violation Consequences
Any member who is found to have knowingly violated copyright law with services provided by MusiciansCollaboration.com, may be suspended or banned from MusiciansCollaboration.com. In addition, MusiciansCollaboration.com will cooperate fully with authorities if legal action is brought against a member.
